These Terms of Use (Terms) govern your access to and use of AfriPhysio Online at afriphysio.online and related services operated by AfriPhysio (we, us, or our). By creating an account or using the Platform, you agree to these Terms and our Privacy Policy.

1. Acceptance of terms

You must read these Terms and our Privacy Policy before using the Platform. If you do not agree, do not create an account or use our services.

If you use the Platform on behalf of an institution or employer, you represent that you have authority to bind that organisation and that it accepts these Terms.

2. Eligibility

AfriPhysio Online is intended for professional healthcare practitioners, instructors, accreditors, and authorised institutional users. You must be at least 18 years old and capable of forming a binding contract under applicable law.

You agree to provide accurate registration information and to keep your account details current. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3. Platform services

AfriPhysio Online provides:

  • Accredited and marketplace continuing professional development (CPD) courses
  • Live webinars and classroom sessions
  • CPD tracking, certificates, and public verification
  • Instructor authoring, review, and payout tools
  • Institutional sponsorship and employer learning programmes
  • Payment processing for paid courses (including M-PESA)

We may modify, suspend, or discontinue features with reasonable notice where practicable. We do not guarantee uninterrupted availability and may perform maintenance that temporarily affects access.

4. Accounts and verification

You must verify your email address before accessing protected features. Learners and instructors may be required to submit professional credentials, licence documents, or other verification materials.

We may approve, reject, or revoke verification status at our discretion to protect accreditation integrity and platform trust. Providing false or misleading credentials may result in immediate suspension or termination.

Instructors may delete their accounts through the Platform subject to confirmation safeguards. Deletion may anonymise certain identifiers while preserving records required for financial, legal, or accreditation purposes.

5. Payments and refunds

Paid courses display prices in the currency shown at checkout. M-PESA payments are initiated via STK push to the phone number you provide. Payment is complete only when we receive a successful confirmation from Safaricom.

Institutional sponsor codes may entitle eligible employees to sponsored access subject to employer programme rules and budget availability.

Refund eligibility depends on course type, consumption of content, accreditation rules, and applicable consumer protection law in Kenya. Unless otherwise stated at checkout or required by law, fees for substantially consumed digital content may be non-refundable. Contact support@afriphysio.online for billing disputes.

Instructors receive revenue shares according to platform settings and payout schedules. AfriPhysio may deduct applicable platform fees, taxes, and chargebacks as disclosed in instructor agreements or dashboard materials.

6. CPD, certificates, and accreditation

CPD points and certificates are issued based on course completion, assessment performance, live-session engagement requirements, and verification status. Official CPD may require verified learner status.

Certificates include a public verification identifier (e.g., QR code) so employers and regulators can confirm authenticity. By receiving a certificate, you acknowledge that limited verification data may be publicly accessible as described in our Privacy Policy.

Accreditation decisions rest with authorised accreditors and governing policies. AfriPhysio facilitates workflows but does not warrant regulatory acceptance in every jurisdiction.

7. Instructor content and licence

Instructors retain ownership of original course content they upload, subject to a worldwide, non-exclusive licence granted to AfriPhysio to host, display, distribute, promote, and deliver that content on the Platform, including for enrolled learners and institutional programmes.

You represent that your content:

  • Does not infringe third-party intellectual property or privacy rights
  • Complies with applicable professional and advertising standards
  • Does not contain unlawful, misleading, or harmful material

We may remove or suspend content that violates these Terms, accreditation requirements, or applicable law.

8. Acceptable use

You agree not to:

  • Circumvent access controls, rate limits, or payment requirements
  • Share account credentials or course materials in violation of licence terms
  • Interfere with live sessions, assessments, or engagement integrity tools
  • Upload malware, scrape the Platform, or attempt unauthorised data extraction
  • Harass, defame, or discriminate against other users or staff
  • Use the Platform for purposes unrelated to professional learning without our consent

We may investigate violations, cooperate with law enforcement, and suspend or terminate accounts. Fraud monitoring and automated integrity checks may be used as described in our Privacy Policy.

9. Institution and employer programmes

Institution administrators are responsible for ensuring they have a lawful basis to upload employee data and for informing employees that learning records will be processed by AfriPhysio.

Employers and institutions may access progress, compliance, and certificate information for enrolled employees according to programme configuration. AfriPhysio is not responsible for employment decisions made using Platform data.

10. Live sessions and third-party tools

Live sessions may use browser-based video (Darasa) or external tools (e.g., Zoom, Google Meet) at an instructor's choice. Camera and microphone access requires your explicit browser permission.

Engagement features (attention checks, chat, polls) may be used for CPD attendance verification. If an instructor uses external conferencing tools, that provider's terms and privacy policy apply to the session hosted on their platform.

11. Intellectual property

The Platform, brand, software, design, and AfriPhysio-owned materials are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, reverse engineer, or create derivative works from our services.

Feedback you provide may be used by AfriPhysio without restriction or compensation to improve the Platform.

12. Disclaimers

The Platform provides professional education and CPD administration. It does not provide clinical care, diagnosis, or treatment. Course content is for educational purposes and does not replace professional judgment or local regulatory requirements.

To the fullest extent permitted by law, the Platform and content are provided "as is" and "as available" without warranties of merchantability, fitness for a particular purpose, or non-infringement.

13. Limitation of liability

To the maximum extent permitted by applicable law, AfriPhysio and its directors, employees, partners, and suppliers shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or business opportunity arising from your use of the Platform.

Our aggregate liability for claims relating to the Platform shall not exceed the greater of (a) amounts you paid to AfriPhysio in the twelve months before the claim, or (b) five thousand Kenyan shillings (KES 5,000), except where liability cannot be limited under the Consumer Protection Act, 2012, the Kenya Information and Communications Act, or other mandatory Kenyan law.

14. Indemnity

You agree to indemnify and hold harmless AfriPhysio from claims, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Platform, or infringement of third-party rights through content you submit.

15. Suspension and termination

We may suspend or terminate your access immediately for breach of these Terms, security risks, fraud, or legal requirements. You may stop using the Platform at any time.

Provisions that by nature should survive termination — including payment obligations, intellectual property, disclaimers, liability limits, indemnity, and dispute resolution — remain in effect.

16. Governing law and disputes

These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law principles, subject to mandatory consumer protections and data protection rights that apply in your jurisdiction.

Disputes should first be raised with support@afriphysio.online. If unresolved within thirty (30) days, disputes shall be submitted to the courts of Nairobi, Kenya, unless applicable law requires another forum.

Nothing in these Terms limits your right to complain to the Office of the Data Protection Commissioner or other competent regulatory authority.

17. Changes to these Terms

We may update these Terms and will post the revised version at afriphysio.online with an updated effective date. Material changes will be communicated through the Platform or email where appropriate. Continued use after the effective date constitutes acceptance, except where further consent is required by law.
